Fines for breaking security industry laws : Department of Employment, Economic Development and Innovation

Penalties

A person who works unlicensed in the security industry faces penalties of up to:

  • $50 000 for the first offence
  • $70 000 fine or six months imprisonment for the second offence
  • $100 000 fine or 18 months imprisonment for the third offence.


A company that operates unlicensed in the security industry faces penalties of up to:

  • $250 000 fine for the first offence
  • $350 000 fine for the second offence
  • $500 000 fine for the third offence.


Anyone who hires an unlicensed security provider faces penalties of up to:

  • $50 000 fine for the first offence
  • $70 000 fine or six months imprisonment for the second offence
  • $100 000 fine or 18 months imprisonment for the third offence.

Licence types

Anyone working in the security industry in Queensland must register with the Office of Fair Trading and may need an individual licence and/or a corporate licence.

Individual - Class 1

  • Bodyguard - providing close personal protection services.
  • Private investigator - obtaining and providing information about another person without their consent, such as surveillance work or investigating the disappearance of a missing person.
  • Crowd controller - maintaining order in and around a public place such as a hotel or sporting event.
  • Cash transit security officer - carrying cash or other valuables.
  • Unarmed security officer - guarding, patroling or watching another person’s property, without a guard dog or weapon.
  • Monitoring security officer - monitoring property using an electronic monitoring devices such as a visual recording system, a radio or remote alarm system.
  • Dog patrol security officer - guarding, patroling or watching another person’s property, with a guard dog.

      Individual - Class 2

      • Security adviser - providing advice about security equipment, methods or principles.
      • Security equipment installer - installing, repairing, servicing or maintaining security equipment.

          Firm

          • Security firm - people, partnerships or corporations engaging security providers.

              Bodyguard

              A bodyguard carries out close personal protective services.

              Eligibility
              To be eligible for a bodyguard licence, you must:

                • be 18 years or older
                • have no recorded conviction of a disqualifying offence within the previous 10 years, or an unrecorded finding of guilt of a disqualifying offence in the previous five years
                • not be considered a risk to public safety
                • have successfully completed the training

              Training requirements for a new licence

              To qualify for an unrestricted bodyguard licence, you must successfully complete the following units of competency from the National Asset Security Training Package.

                Triennial training (revalidation training)

                Some units in the above list have the letters 'TR' at the end, which stands for 'triennial revalidation'. Every three years, as a licensed bodyguard, you need to successfully complete these units again through a nationally recognised training provider to ensure you remain up to date with the latest techniques. You will receive the required completion dates for these competencies on the notice supplied with your security licence.

                Recognition of prior learning will not be accepted for triennial training units.

                Training requirements for renewing a licence

                If you held a crowd controller licence on 30 June 2008, you automatically qualify for a bodyguard licence when your licence is due for renewal.

                To qualify, you must complete a new application form to add the bodyguard function to your licence at renewal time and provide either a statutory declaration from your employer or a signed letter from your employer on company letterhead stating that you have performed bodyguard duties for at least three months in the 12 months prior to renewal.

                If you are self employed, you must complete a statutory declaration yourself. It must outline the periods you provided bodyguard services.

                If you cannot provide this evidence, or if you had a security officer licence as at 30 June 2008, you are eligible to get a bodyguard licence if you successfully complete these competency units:

                Private Investigator

                A private investigator:

                • obtains private information about a person without that person’s permission
                • carries out surveillance to gather information about a person without that person’s consent
                • investigates the disappearance of a missing person
                • You are not a private investigator if you operate for or are employed by:
                    • legal practitioners
                    • accountants
                    • insurance businesses
                    • insurance adjustment agencies
                    • independent investigators engaged to investigate and report on grievances lodged by Queensland public service employees

                Eligibility
                To be eligible for a private investigator licence, you must:

                  • be 18 years or older
                  • have no recorded conviction of a disqualifying offence within the previous 10 years, or an unrecorded finding of guilt of a disqualifying offence in the previous five years
                  • not be considered a risk to public safety
                  • have successfully completed a Certificate III in Investigative Service

                Training requirements for a new licence

                To qualify for an unrestricted private investigator licence, you must successfully complete the following units of competency from the National Asset Security Training Package.

                Crowd controller

                A crowd controller keeps order at a public place by:

                  • screening the entry of people into a place monitoring or controlling the behaviour of people in a place
                  • removing people from a place.
                  • For example, a hotel security guard needs a crowd controller licence but an usher does not.

                Eligibility
                To be eligible for a crowd controller licence, you must:

                  • be 18 years or older
                  • have no recorded conviction of a disqualifying offence within the previous 10 years, or an unrecorded finding of guilt of a disqualifying offence in the previous five years
                  • not be considered a risk to public safety
                  • have successfully completed the training.

                Training requirements for a new licence

                To qualify for an unrestricted crowd controller licence, you must successfully complete the following competency units from the National Asset Security Training Package.

                If you had a security officer licence on 30 June 2008, you are eligible to get a crowd controller licence if you successfully complete these competency units:

                Cash transit security officer

                A cash transit security officer carries cash, bullion, jewellery or valuables. Officers who carry a weapon while working must also apply to the Queensland Police Service for the appropriate weapons licence.

                To be eligible for a cash transit security officer, you must:

                  • be 18 years or older
                  • have no recorded conviction of a disqualifying offence within the previous 10 years, or an unrecorded finding of guilt of a disqualifying offence in the previous five years
                  • not be considered a risk to public safety
                  • have successfully completed the training

                Unarmed security officer 

                An unarmed security officer personally guards, patrols or watches another person’s property, without a guard dog or weapon.

                This also includes:

                in-house security (someone who guards, patrols or watches their employer’s property)
                loss prevention personnel
                security gate operators

                To be eligible for an unarmed security officer licence, you must:

                  • be 18 years or older
                  • have no recorded conviction of a disqualifying offence within the previous 10 years, or an unrecorded finding of guilt of a disqualifying offence in the previous five years

                Dog patrol security officer 

                A dog patrol security officer guards, patrols or watches another person’s property with a guard dog.

                Security adviser  

                A security adviser gives advice about security equipment, methods or principles.

                Architects and registered professional engineers do not have to be licensed if their advice is given in the course of providing professional services.

                Eligibility
                To be eligible for a security adviser licence, you must:

                  • be 18 years or older
                  • have no recorded conviction of a disqualifying offence within the previous 10 years, or an unrecorded finding of guilt of a disqualifying offence in the previous five years
                  • not be considered a risk to public safety

                Training requirements

                Currently security advisers do not have any training requirements.

                Security equipment installer 

                A security equipment installer installs, repairs, services or maintains security equipment.

                Security equipment is acoustic, electronic, mechanical or other equipment designed or adapted to provide, monitor or enhance property for protection.

                Examples include:

                    • alarms
                    • alarm monitoring systems
                    • audio or visual recording systems
                    • electric, electro-magnetic or biometric access control devices
                    • intrusion detectors, including motion, infra-red, microwave or contact detectors
                    • safes or vaults.

                Equipment for monitoring inventory, product or stock loss, or items that minimise motor vehicle theft, are not considered security equipment.

                You are not a security equipment installer if you install a basic security item or do retail key cutting.

                Basic security items can include:

                • portable safes weighing less than 50 kg
                • barrier security equipment, such as security mesh doors or window grilles
                • electronic or mechanical locks for basic household security
                • motion sensor lights that do not activate alarms.

                Eligibility
                To apply for a security equipment installer licence, you must:

                  • be 18 years or older
                  • have no recorded conviction of a disqualifying offence within the previous 10 years, or an unrecorded finding of guilt of a disqualifying offence in the previous five years
                  • not be considered a risk to public safety

                Training requirements

                Currently security equipment installers do not have any training requirements.

                Security firm 

                A security firm is a person, partnership or corporation that provides security firm services.

                Class 1 security firm services are provided by bodyguards, crowd controllers, private investigators or security officers.

                Class 2 security firm services are provided by security advisers or security equipment installers.

                Eligibility
                Security firms do not need specific qualifications to hold a licence.

                However, all management staff must:

                  • be 18 years or older
                  • have no recorded conviction of a disqualifying offence within the previous 10 years, or an unrecorded finding of guilt of a disqualifying offence in the previous five years
                  • not be considered a risk to public safety
                  • hold a security provider licence as an individual (if personally carrying out security functions)
                  • have a business address.

                You only need a security firm licence if your firm provides security services. If your company sub-contracts work to others, you do need a security firm licence. (This applies to Security Firms that sub-contract work to others i.e. Alarm Responses)
